1. Overview

These Terms and Conditions ("Terms") govern your purchase and use of SwitchMyMagic ("the Software"), a macOS application developed and sold by SwitchMyMagic ("we", "us", "our"). By purchasing or using the Software, you agree to be bound by these Terms.

2. License

Upon purchase, we grant you a limited, non-exclusive, non-transferable license to install and use the Software on the number of Mac computers permitted by the license variant you purchased:

  • 2-Device License — install and activate on up to 2 Macs.
  • 5-Device License — install and activate on up to 5 Macs.

You may not redistribute, sublicense, resell, reverse-engineer, or modify the Software.

3. Payment and Pricing

SwitchMyMagic is sold as a one-time purchase. All payments are processed by Polar, our merchant of record. Prices are displayed at the time of purchase and may be subject to applicable taxes based on your location. We reserve the right to change pricing at any time, but price changes will not affect existing purchases.

4. Refund Policy

We offer a 14-day money-back guarantee from the date of purchase. If you are not satisfied with the Software for any reason, you may request a full refund within 14 days of your purchase by contacting us at [email protected]. Refunds are processed through Polar and typically take 5-10 business days to appear on your statement. After 14 days, refunds are granted at our discretion on a case-by-case basis.

5. Updates

Your purchase includes free updates to the Software for the lifetime of the product. Updates are delivered automatically through the built-in Sparkle updater. We are not obligated to provide updates indefinitely but intend to maintain the Software for the foreseeable future.

6. System Requirements

The Software requires macOS 13 (Ventura) or later and a Mac with Bluetooth capability. The Software is designed to work with Apple Magic Keyboard, Magic Trackpad, and Magic Mouse devices. We do not guarantee compatibility with future macOS versions or hardware changes, though we will make reasonable efforts to maintain compatibility.

7. Disclaimer of Warranties

The Software is provided "as is" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Software will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Software. Our total liability for any claim arising from these Terms or the Software shall not exceed the amount you paid for the Software.

9. Termination

We may terminate your license if you violate these Terms. Upon termination, you must cease all use of the Software and delete all copies. You may deactivate your license at any time through the Software's menu.

10. Changes to These Terms

We may update these Terms from time to time. The revised version will be posted on this page with an updated date. Continued use of the Software after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
